Dear user, we ask that you carefully read the following Terms and Conditions of Use and Privacy, as simply using or accessing any of the pages that make up the Website https://publicidad.express ("The Site"), you are deemed to accept and agree to be bound by the terms and conditions described herein.

In the event that you do not agree with the Terms and Conditions of Use and Privacy, you must refrain from using the Site.

  1. USE AND RESTRICTIONS. The use of the Site constitutes the user's full and unreserved acceptance of these Terms and Conditions of Use and Privacy. Through the Portal, the user will access and/or use various services and content (hereinafter, the "Services and Content"), made available to users by members of "The Site", and/or its subsidiaries and affiliates (hereinafter, "The Site"), and/or by third-party providers of Services and Content. The Site shall have the right to deny, restrict, or condition the user's access to the Site, in whole or in part, at its sole discretion, as well as to modify the Site's Services and Content at any time and without prior notice.

The user acknowledges that not all Services and Content are available in all geographic areas and that certain Services and Content may only be accessed following prior enrollment or registration by the user and/or payment of a fee, as expressly specified in the relevant “Specific Terms” (as such term is defined in clause 12). The Site does not warrant the availability and continuous operation of the Site and the Services and Content, nor the fitness of the Site or the Services and Content for any specific activity. The Site shall not be liable for any damage or loss of any nature that may arise from the lack of availability or continuous operation of “The Site” and/or the Services and Content.

  1. INTELLECTUAL PROPERTY. The intellectual property rights regarding the Services and Content, distinctive signs, and domains of the Site, as well as the rights of use and exploitation thereof, including their disclosure, publication, reproduction, distribution, and transformation, are the exclusive property of The Site. The user acquires no intellectual property right merely by using the Services and Content of the Site, and at no time shall such use be deemed an authorization or license to use the Services and Content for purposes other than those contemplated in these Terms and Conditions of Use and Privacy.

  2. THIRD-PARTY INTELLECTUAL PROPERTY. The user agrees that the provisions established in subsection 2 above regarding the ownership of The Site's rights also apply to third-party rights regarding the Services and Content of the pages linked to the Site.

  3. PERMITTED USES. The use of the Site's Services and Content is the sole responsibility of the user, who must in all cases utilize them in accordance with the functionalities permitted on the Site itself and the uses authorized under these Terms and Conditions of Use and Privacy. Therefore, the user agrees to use them in a manner that does not violate internet standards of conduct and coexistence, the laws of the United Mexican States, the prevailing legislation in the country where the user is located when using them, common decency, human dignity, and the rights of third parties. The Site is for personal use by the user; therefore, the user may not commercialize The Site's Services and Content in any way.

  4. PROHIBITIONS. The user does not have the right to place hyperlinks to and from the Site, nor the right to place or use the Portal's Services and Content on their own or third-party sites or pages without prior written authorization from The Site. Likewise, the user shall not have the right to limit or prevent any other user from using the Site.

  5. QUALITY OF SERVICES AND CONTENT. Neither The Site nor its suppliers or business partners shall be held liable for any loss or damage suffered by the user as a result of inaccuracies, typographical errors, and changes or improvements made periodically to the Services and Content. Recommendations and advice obtained through the Site are general in nature, and therefore should not be relied upon in making personal decisions. For such matters, an appropriate professional must be consulted who can advise the user based on their specific needs.

  6. THIRD-PARTY LINKED GOODS AND SERVICES. Regarding the Services and Content provided by third parties within or via links to the Site (such as links, banners, and buttons), the Site is exclusively limited, for the user's convenience, to: (i) informing the user about them, and (ii) providing a means to connect the user with vendors or sellers. The products and/or services marketed within the Site and/or on third-party linked sites are provided by independent merchants unaffiliated with the Site. The Site is not and may not be considered a provider of the goods and/or services offered on such pages and/or sites. The inclusion of such pages and/or links does not imply approval, endorsement, sponsorship, recommendation, or warranty by the Site regarding the services and goods marketed therein or the content of such pages. No employment relationship, partnership, or joint venture exists between the Site and such third parties. All guidance, advice, statements, information, and content on third-party pages linked to or within the Site represent the opinions and judgments of said third party; consequently, the Site shall not be liable for any damage or injury suffered by the user as a result thereof, including, but not limited to, damages caused by data or program loss.

  7. CONFIDENTIALITY. The Site undertakes to maintain confidential the information it receives from the user that has such character under applicable legal provisions in the United Mexican States. The Site assumes no obligation to maintain confidential any other information provided by the user, whether upon registering on The Site or at any later time, including information provided by the user through newsletters, message boards, or online chat, as well as information obtained by The Site through the Cookies described in section 10.

  8. USE OF NON-CONFIDENTIAL INFORMATION. By using the Site, the user authorizes The Site to use, publish, reproduce, disclose, publicly communicate, and transmit non-confidential information, pursuant to the provisions of Article 109 of the Federal Copyright Law and Section I of Article 76 bis of the Federal Consumer Protection Law.

  9. COOKIES. Users accessing the Site agree to receive cookies transmitted by The Site's servers. “Cookie” means a data file stored on the user’s computer hard drive when they access the Site. Cookies may contain information such as user identification or data used to track pages the user has visited. A Cookie cannot read data or information from the user’s hard drive, nor can it read Cookies created by other sites or pages.

  10. ACCESS CODES AND CONFIDENTIAL NUMBERS. At all times, the user is solely and ultimately responsible for keeping secret their account numbers, personal passwords, access codes, and confidential numbers through which they access the Services and Content of the Site, as well as third-party pages.

  11. MODIFICATIONS. The Site reserves the right to modify the Terms and Conditions of Use and Privacy at any time. Consequently, the user must carefully read the Terms and Conditions of Use and Privacy each time they intend to use the Site. Certain Services and Content offered to users on and/or through the Site are subject to specific individual conditions that replace, supplement, and/or modify the Terms and Conditions of Use and Privacy (hereinafter, the “Special Conditions”). Accordingly, the user must also carefully read the corresponding Special Conditions before accessing any Services and Content.

  12. APPLICABLE LAWS AND JURISDICTION. For the interpretation, compliance, and enforcement of this Agreement, the parties agree that the Federal laws of the United Mexican States shall apply, and the courts of the City of Santiago de Querétaro, Querétaro, shall have jurisdiction, expressly waiving any other forum or jurisdiction that may correspond to them by reason of their present or future domiciles.

  13. In the case of SMS delivery to your phone number. You can stop receiving messages from our SMS messaging service with the word STOP. From that moment on, our system stops sending SMS Messages. In order to receive SMS messages, you only need to enter our site from a mobile device and click on the floating SMS message bubble in the bottom-left corner.
